1. यूट्यूब पॉडकास्ट अंतर्ग्रहण सेवा।

1.1. पॉडकास्ट अंतर्ग्रहण सेवा प्रदाता।

2. पॉडकास्ट अंतर्ग्रहण सेवा तक पहुंच।

2.1. पात्रता मापदंड।

पॉडकास्ट अंतर्ग्रहण सेवा का उपयोग करने के लिए, आप स्वीकार करते हैं और सहमत होते हैं कि निम्नलिखित सत्य हैं और हर समय सत्य रहेंगे:

2.2. सत्यापन.

पॉडकास्ट अंतर्ग्रहण सेवा के माध्यम से YouTube पर पॉडकास्ट सबमिट करने के लिए, आपको यह साबित करना होगा कि आप उस पॉडकास्ट के लिए सबमिट किए गए RSS फ़ीड के मालिक हैं या उस पर नियंत्रण रखते हैं। यहां RSS फ़ीड सत्यापन प्रक्रिया के बारे में कुछ विवरण दिए गए हैं।

2.3. निषिद्ध उपयोग.

3. पॉडकास्ट अंतर्ग्रहण।

YouTube Podcast Ingestion Service Terms of Service

Welcome to the YouTube Podcast Ingestion Service!

1. The YouTube Podcast Ingestion Service.

Thank you for using the YouTube platform and the products, services and features we make available to you as part of the platform (collectively, the “Service”). The YouTube Podcast Ingestion Service (the “Podcast Ingestion Service” or any other name as YouTube may designate for the service) is being made available as a convenience to eligible podcast creators and distributors (“you”, “your”) to facilitate the distribution of your podcasts on the Service. In the Podcast Ingestion Service, you may upload your podcast content by submitting the URL of the RSS feed(s) (all such submitted podcasts, collectively, your “Podcasts”). Your Podcasts include all associated metadata, audio files, images, transcripts and other resources available or referenced in the RSS feed you submit. You may use the Podcast Ingestion Service only for your wholly original Podcasts and for Podcasts that you have authorization to (1) use, license, reproduce and exploit on a worldwide basis and (2) permit YouTube to access and distribute as set forth in the Terms (defined below).

1.1. Podcast Ingestion Service Provider.

The entity providing the Podcast Ingestion Service is Google LLC, located at 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("YouTube”, "we", "us", or "our"). We may use other companies within the Alphabet Inc. corporate group, now or in the future (these companies are referred to as our “Affiliates”) to manage the Podcast Ingestion Service.

1.2. Applicable Terms.

Your use of the Podcast Ingestion Service is subject to: (1) the YouTube Terms of Service (including, for clarity, the governing law and limitation of liability provisions) and any other agreement that you have entered into with us that governs the licensing and monetization of your content on YouTube, including a content licensing agreement (if applicable to you), the Community Guidelines and the Policy, Safety and Copyright Policies (each of which may be updated from time to time and are incorporated herein by reference) (collectively, the “YouTube Terms and Policies”) and (2) these YouTube Podcast Ingestion Service Terms of Service (“Podcast Ingestion Terms”). If there is a conflict between the YouTube Terms and Policies and these Podcast Ingestion Terms, the Podcast Ingestion Terms will take precedence. We’ll refer to all the terms and policies listed in this Section 1.2 collectively as the “Terms.”

Please read the Terms carefully and make sure you understand them. If you do not understand the Terms, or do not accept any part of them, then you may not use the Podcast Ingestion Service.

2. Accessing the Podcast Ingestion Service.

2.1. Eligibility Criteria.

In order to use the Podcast Ingestion Service, you acknowledge and agree that the following are true and will remain true at all times:

You have a Google account. You can follow these instructions to create a Google account.
You have a YouTube channel and it is in compliance with the Terms. Here are some details about how to create your own YouTube channel.

2.2. Verification.

To submit a Podcast to YouTube via the Podcast Ingestion Service, you must prove that you own or control the RSS feed you submit for that Podcast. Here are some details about the RSS feed verification process.

2.3. Prohibited Uses.

In addition to any prohibitions in the YouTube Terms and Policies, when you use the Podcast Ingestion Service, you may not (and may not attempt to) do any of the following:

use the Podcast Ingestion Service in an illegal manner, or for an illegal purpose;
identify and submit any Podcasts that (1) you do not own or control, (2) are subject to exclusive licenses, (3) contain third-party content (e.g., advertisements) that you do not own, control or for which you are not authorized to grant to YouTube the rights granted in the Terms, or (4) violate any of the Terms; or
submit any Podcasts if their submission, or the use thereof by YouTube, would violate any third-party rights and/or terms, including any terms applicable to the RSS feed of your Podcasts.

2.4. Your Information.

Our Privacy Policy explains how we treat your personal data and protect your privacy when you use the Podcast Ingestion Service. Please read the Privacy Policy carefully.

3. Podcast Ingestion.

You may submit your Podcasts to YouTube by providing the URL of the RSS feed for your Podcast in YouTube Studio (you can learn more about this on our Help Center). If you submit any Podcasts via the Podcast Ingestion Service, YouTube may cap the number of Podcast episodes that can be uploaded per day (you can learn more about this on our Help Center). YouTube may continue to upload episodes of your Podcasts from your RSS feed until you disconnect your RSS feed from your Podcast on YouTube Studio. Once YouTube has downloaded an episode of your Podcast, it will not re-download that episode, as defined by the episode’s globally unique identifier (GUID), even if the URL changes, unless you direct YouTube to do so in YouTube Studio.

4. Podcast License Terms.

4.1. Licensed Rights.

When you upload Podcasts via the Podcast Ingestion Service, you grant YouTube the royalty free right to access, fetch and download your Podcasts (including all episodes of your Podcasts available now and in the future). You also agree to YouTube’s reproducing, storing, adapting, transcoding, encoding, uploading to your channel, making publicly available, publicly performing and distributing your Podcasts (including on an audio-only basis) on the Service, on your behalf, royalty free. Once your Podcasts have been uploaded to YouTube, the YouTube Terms and Policies, including all terms relating to your rights of ownership in the Podcasts and grant of license to YouTube, apply to all of your Podcasts as if you had uploaded the Podcasts directly to the Service, and for clarity, such Podcasts will be deemed Content (or “Provider Content” where applicable) uploaded by you under the YouTube Terms and Policies.

4.2. Representations and Warranties.

In addition to all representations and warranties you provide in YouTube Terms and Policies, You represent and warrant that (1) you have the full power and authority to grant to YouTube the rights granted herein and to authorize YouTube to use and distribute all the Podcasts in accordance with these Terms and (2) your conduct and all Podcasts you submit will at all times comply with the Terms and all applicable laws, rules and regulations. For example, the Podcasts you submit must not contain third-party intellectual property (such as copyrighted material) unless you have permission from all applicable rightsholders or are otherwise legally entitled to do so. You are legally responsible for all of your Podcasts.

4.3. Indemnification.

Your indemnity obligations in the YouTube Terms and Policies (if any) apply to your use of the Podcast Ingestion Service, including to any violation by you of these Podcast Ingestion Terms.

5. Changes.

5.1. Changes to the Podcast Ingestion Service.

We’re constantly developing new features and ways to improve our services and we may modify the Podcast Ingestion Service from time to time as set out in the YouTube Terms of Service.

5.2. Changes to these Podcast Ingestion Terms.

YouTube may change these Podcast Ingestion Terms (1) to reflect changes to our Podcast Ingestion Service or how we do business - for example, when we add new products or features or remove old ones, (2) for legal, regulatory, safety or security reasons, or (3) to prevent abuse or harm. If we materially change the Podcast Ingestion Terms, we will provide you with reasonable advance notice and the opportunity to review the changes (except when we launch a new product or feature or in urgent situations, such as preventing ongoing abuse or responding to legal requirements). If you do not accept the updated Podcast Ingestion Terms then you may no longer use the Podcast Ingestion Service and you must unlink your RSS URL for your Podcasts in YouTube Studio. For clarity, the latest version of the Podcast Ingestion Terms that you accepted will continue to apply to previously submitted and ingested episodes of your Podcasts.

6. Suspension & Termination.

You may stop using the Podcast Ingestion Service at any time by unlinking the URL for the RSS feed for your Podcasts in YouTube Studio. We may suspend or terminate your access to the Podcast Ingestion Service if (a) we reasonably believe that you are materially or repeatedly in breach of the Terms; (b) we are required to do so to comply with a legal requirement or a court order; or (c) we reasonably believe that there has been conduct that creates (or could create) liability or harm to any user, other third party, us, or our Affiliates.

We will notify you with the reason for our suspension or termination unless we reasonably believe that to do so would: (a) violate the law or the direction of a legal enforcement authority; (b) compromise an investigation; (c) compromise the integrity, operation, or security of the Podcast Ingestion Service; or (d) cause harm to any user, other third party, us, or our Affiliates.

If you believe that the suspension or termination has been made in error, you can follow the appeals process on our Help Center.

7. Other Terms.

7.1.

Capitalized terms used but not defined in these Podcast Ingestion Terms will have the meanings given to such terms in the agreement that governs the licensing and, if applicable, monetization of your content on the Service, including a content licensing agreement or the YouTube Terms of Service, as applicable.

7.2.

OTHER THAN AS EXPRESSLY STATED IN THIS AGREEMENT OR AS REQUIRED BY LAW, THE PODCAST INGESTION SERVICE IS PROVIDED “AS IS” AND, TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOUTUBE DOES NOT MAKE ANY SPECIFIC COMMITMENTS OR WARRANTIES ABOUT THE PODCAST INGESTION SERVICE. FOR EXAMPLE, TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DON’T MAKE ANY WARRANTIES ABOUT: (A) THE CONTENT PROVIDED THROUGH THE PODCAST INGESTION SERVICE; (B) THE SPECIFIC FEATURES OF THE PODCAST INGESTION SERVICE, OR ITS ACCURACY, RELIABILITY, AVAILABILITY, OR ABILITY TO MEET YOUR NEEDS; OR (C) THAT ANY CONTENT YOU SUBMIT VIA THE PODCAST INGESTION SERVICE WILL BE ACCESSIBLE ON THE SERVICE.
